Should special conditions apply to individual functions of this website and differ from the Terms of Usage below, reference is made to this. In each individual case, the special Terms of Usage apply in a supplementary fashion.
This website contains data and information of all kinds that are subject to trademark and/or intellectual property rights in our name or, in individual cases, in the name of third parties. Thus the downloading of the website either in whole or in part, the duplication and transmission of the website are not permitted. The only permitted action is the technologically necessary duplication for browsing purposes, given this action serves no commercial purpose.
Placement of a link on this website without our consent is not permitted, even if it merely serves cross-referencing purposes. Framing this website or placing a link, including but not limited to an inline link, hyperlink or a deep link, is not permitted.
We assume liability for the contents of our website in accordance with legal statutes. We assume no liability for loss of users’ data.
4. Users’ Obligations
Users agree to refrain from all actions which could endanger or disrupt the functioning of the website and Internet shop, and to refrain from accessing data for which they have no authorisation. In addition, they must ensure that the information and data they provide via the Internet are free of viruses, worms, Trojan horses or other malware that would negatively affect the functioning of the website or the Internet shop. Users agree to reimburse us for all damages resulting from the failure to comply with these obligations and to indemnify us from any and all third-party claims, including but not limited to the expenses for legal counsel and court costs, if we are found liable due to a user’s failure to comply with these obligations.
We provide no warranty regarding the correctness or completeness of the information found on the website. References to links, websites, databases or third-party services do not mean that we stand behind the contents to which these references or links lead the user. The contents do not mean that we assume responsibility for the data and information provided there. We have no influence on the contents to which any given link may lead. 6. Security and Accessibility
The Internet is a system without security. There can be no guarantee that data are protected from access by third parties during data transmission. Users make use of the Internet at their own risk. In particular, we assume no liability for disruptions in Internet functioning and/or accessibility caused by technical problems. In addition, we cannot guarantee that our homepage can be used and will function properly at all times. Thus we assume no liability for the continuous and uninterrupted accessibility of our Internet shop or for technical and electronic defects or problems that occur when an order is placed; this particularly includes delays in the processing and acceptance of quotes/bids. We also assume no liability for disruptions or problems within the IT network. In the case of technical problems, users are requested to contact us by telephone, fax, email or letter.
7. Place of Jurisdiction
The place of jurisdiction is our office in Ludwigshafen, Germany. Only German law applies. Neither international contract laws nor the United Nations Convention on Contracts for the International Sale of Goods (CISG) apply.
8. Concluding Provisions
We reserve the right to modify these Terms of Usage and to adapt them to technical and legal developments. Should individual provisions of this usage agreement prove invalid, this shall not affect the validity of the remainder of the agreement. The invalid provision is to be replaced by a provision that approximates, as closely as possible, the commercial purposes of the invalid provision. The same applies to any omissions in these Terms of Usage.
